These Terms of Purchase (“Terms”) govern the purchase of all products and services (“Goods and Services”) offered by Blue Byte Systems Inc. (“we,” “us,” or “our”).
By purchasing any of our Goods and Services, you (“Customer”) agree to be bound by these Terms. If you do not agree, do not proceed with the purchase or use of our Goods and Services.
All product descriptions, specifications, and images are for informational purposes only and may be modified without notice. While we strive to maintain accuracy, we do not guarantee that all information is current or error-free. Product availability is subject to change.
Service descriptions are also for informational purposes and may be updated without notice. Availability of services depends on our internal capacity and other business factors.
Orders may be placed through our website, by phone, or through authorized channels. All orders are subject to our acceptance and availability.
Payment must be made in full at the time of order unless agreed otherwise in writing. Accepted payment methods include credit cards, debit cards, and bank transfers.
Products are shipped to the Customer’s provided shipping address. Shipping fees are calculated based on method and destination.
We will make commercially reasonable efforts to deliver Goods and perform Services in a timely manner. However, all delivery timelines are estimates only and not guaranteed. We are not responsible for delays caused by carriers, weather, or other unforeseen events.
Risk of loss transfers to the Customer once the Product is handed over to the shipping carrier.
All sales are final. Blue Byte Systems Inc. does not offer refunds, returns, or exchanges for any products or services, unless required by applicable law.
Some Goods or Services may include limited warranties. Please refer to individual product or service documentation for specific warranty terms and conditions.
EXCEPT AS EXPRESSLY SET FORTH IN A WRITTEN WARRANTY, ALL GOODS AND SERVICES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the fullest extent permitted by law, Blue Byte Systems Inc. assumes no liability whatsoever for any direct, indirect, incidental, consequential, special, or punitive damages of any kind, including without limitation, loss of profits, business interruption, data loss, or other commercial damages or losses, arising out of or related to the use of, misuse of, or inability to use our Goods and Services, even if advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Blue Byte Systems Inc., its officers, directors, employees, and agents from any claims, losses, liabilities, damages, or expenses (including legal fees) arising out of your use or misuse of our Goods and Services or your violation of these Terms.
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts located in British Columbia.
These Terms constitute the entire agreement between you and Blue Byte Systems Inc. and supersede any prior agreements or communications regarding the purchase of Goods and Services.
